1. Agreement
These Terms of Service (“Terms”) govern your use of Babot — our WhatsApp AI receptionist — and the related services we provide through babot.barium.in. By signing up, paying for, or using Babot, you (“Customer,” “you”) agree to these Terms with Barium In. (“Barium,” “we,” “us”).
If you don’t agree to these Terms, please don’t use Babot.
2. The service
Babot is a software-as-a-service product that:
- Replies to customer messages on your WhatsApp Business number, around the clock.
- Reads service and pricing information from a catalog you maintain.
- Books appointments and sends reminders (Premium tier and above).
- Escalates difficult or out-of-scope conversations to a member of your staff.
- Provides you with a dashboard to review conversations and metrics.
What Babot is not:
- A replacement for human judgement on legal, medical, or financial questions.
- A guarantee that every customer interaction will be perfect — large language models are statistical and can occasionally err. See Section 11.
- A telephony or SMS product. Babot operates on WhatsApp, not phone or SMS.
3. Who can use Babot
You can sign up for Babot if:
- You are at least 18 years old.
- You’re authorised to bind your business to these Terms.
- Your business is lawfully registered or operating.
- Your intended use complies with applicable laws and with Meta’s WhatsApp Business Solution Terms.
4. Account and access
You’re responsible for keeping your login details and passwords confidential, and for activity that happens under your account. If you notice unauthorised access, tell us immediately at support@barium.in.
5. Subscription and billing
Plans
Babot is sold on a subscription basis. Plan details (Growth, Premium, Enterprise) and prices are published on this website. We may change pricing or plan composition with 30 days’ notice; changes apply to your next billing cycle.
Free trial
New subscribers get a 7-day free trial. We don’t charge during the trial period. To continue using Babot after the trial, you’ll be auto-charged on day 8 at the plan you selected. You can cancel any time during the trial by writing to support@barium.in — cancel before day 8 and you won’t be charged.
Billing
After the trial, you’re billed monthly or annually, depending on the cycle you chose. Payments are processed by Razorpay under their own terms. We don’t store your full card or bank details.
Renewals
Subscriptions auto-renew at the end of each billing cycle. You can cancel future renewals from your account or by writing to support@barium.in. Cancellation takes effect at the end of your current billing period — you keep access until then.
Refunds
We don’t offer refunds for partial periods, because Babot is metered on operational cost (AI calls, WhatsApp messages, hosting). The 7-day free trial is the standard way to evaluate the service before committing. Exceptions:
- If we charged you in error, we’ll refund promptly.
- If we fail to deliver the service for an extended period due to our fault, we’ll credit or refund pro-rata at our discretion.
- Enterprise contracts have their own refund terms in the individual agreement.
Taxes
Prices are exclusive of GST and other applicable taxes unless explicitly stated otherwise. We issue GST-compliant invoices for Indian customers.
6. Your responsibilities
When you use Babot, you agree to:
- Provide accurate, complete, and up-to-date information during onboarding.
- Keep your services catalog and pricing accurate — Babot quotes what you tell it.
- Use Babot only for lawful business purposes. No spam, harassment, fraud, abusive content, illegal goods, or illegal services.
- Comply with Meta’s WhatsApp Business Solution Terms. Babot operates through the WhatsApp Business API and your account is subject to Meta’s rules.
- Obtain any required consent from your customers (end-users) before communicating with them over WhatsApp. India’s regulations and Meta’s policies both require opt-in.
- Not use Babot to send unsolicited bulk messages or promotional broadcasts that don’t comply with WhatsApp’s policies.
- Not attempt to reverse-engineer, scrape, or copy the underlying Babot software, models, or infrastructure.
- Not use Babot to develop a competing product.
We may suspend or terminate your account if you violate these obligations. See Section 14.
7. Your data and ownership
You own your business data — your services list, pricing, brand-voice configuration, conversation history. We process this data on your behalf to run Babot. You can export your data or delete your account at any time.
End-user data (the messages your customers send to your business via Babot) is also your responsibility as the controller of that customer relationship. We act as the processor. Our handling is described in our Privacy Policy.
8. Our intellectual property
Babot the product — the software, the AI configuration, the website, the branding, the documentation — is our intellectual property. You get a non-exclusive, non-transferable, revocable licence to use Babot for the duration of your subscription. The licence ends when your subscription ends.
We may use aggregate, de-identified data (e.g., “average response time across all Growth-tier customers”) to improve Babot and to publish public metrics or marketing copy. We will never publish identifiable customer data without your written permission.
9. Third-party services
Babot integrates with services run by third parties — including but not limited to Meta (WhatsApp Business Platform), Razorpay, Google (Calendar, Sheets), OpenAI and Anthropic (AI model providers), Zoho, Cloudflare, and Chatwoot. Your use of these services is governed by their respective terms.
We don’t control these third parties and aren’t responsible for outages or changes on their side — but we do our best to choose reliable partners and to keep Babot working when one of them is temporarily unavailable.
10. Availability and changes to the service
We aim for high availability but don’t guarantee uninterrupted service. Maintenance windows, third-party outages, and unforeseen issues can interrupt Babot from time to time. Enterprise customers have specific availability commitments set in their individual contracts.
We may add, change, or remove features at our discretion. We won’t materially reduce the functionality of a paid plan without notice.
11. Warranties and disclaimers
Babot is provided “as is” and “as available.” We don’t warrant that:
- Every response Babot generates will be perfectly accurate. Large language models are statistical and can occasionally produce wrong or inappropriate output. Babot is configured to escalate when it can’t be sure, but you should still review its work.
- The service will be uninterrupted or error-free.
- The service will meet every specific requirement you have.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
12. Limitation of liability
To the maximum extent permitted by Indian law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of goodwill, or loss of data — even if we were warned of the possibility.
- Our total liability to you for any claim relating to Babot is capped at the amount you paid us in the 12 months preceding the event giving rise to the claim.
- This cap does not apply to liability we cannot lawfully limit (e.g., gross negligence, fraud, or statutory liabilities that can’t be excluded under Indian law).
13. Indemnity
You agree to indemnify Barium against any claims, damages, or costs arising out of:
- Your breach of these Terms.
- Your violation of any law or third-party right.
- Content you (or your customers messaging your business) submit through Babot that is unlawful, infringing, or harmful.
14. Termination
By you: Cancel any time. Your access continues until the end of your current billing cycle.
By us: We may suspend or terminate your account if:
- You’re in material breach of these Terms and haven’t cured the breach within 14 days of our written notice.
- You’re in violation of Meta’s WhatsApp Business Solution Terms.
- You haven’t paid your bill within 30 days of the due date.
- We’re legally required to do so.
On termination, your access ends; we retain your data per our Privacy Policy retention schedule; fees already paid for the current period are non-refundable except as described in Section 5.
15. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts in Dharamshala, Himachal Pradesh, India.
Before formal proceedings, you agree to make a good-faith effort to resolve the dispute by writing to support@barium.in. We commit to the same.
16. Changes to these Terms
We may update these Terms from time to time. For material changes, we’ll email registered subscribers and post a notice on this page at least 14 days before the change takes effect. The “Last updated” date at the top of this page always reflects the most recent revision. Continuing to use Babot after the effective date of an update constitutes acceptance of the updated Terms.
17. Miscellaneous
- Entire agreement: These Terms (together with our Privacy Policy and any plan-specific or individually negotiated agreement) are the entire agreement between you and Barium.
- Severability: If any part of these Terms is held unenforceable, the rest remains in force.
- No waiver: If we don’t enforce a right, that doesn’t mean we waive it.
- Assignment: You can’t assign these Terms without our written consent. We can assign these Terms to a successor in connection with a corporate change.
